Internet Services

1.  Definitions

Services” means domain registration, web site designing, email facility and any other web/Internet service or facility provided by us to you.
 “Server” means the computer equipment used by us or associated companies in connection with the provision of such Services.
Web Site” means the space on the server allocated by us or associated companies for use by you as a web site on the Internet. 
We” / "Us" means Mike Pitches Computer Services
You” means you, the Client.

2.  Domain Name Registration / Web Site Hosting

2.1.  We make no representation that the domain name that you wish to register is capable of being registered for you, or that it will be registered in your name.  It is important that you do not assume that your chosen domain name is fully registered to you until we notify you by email or in writing that this is the case.  Any action taken by you before such notification is therefore at your own risk.

2.2.  The registration and use of your agreed domain name is subject to the terms and conditions of Mike Pitches Computer Services, and also of our associated Companies; it is important that you understand and comply with them.  You will have no right to claim against us in respect of a refusal to register a domain name.

2.3.  We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such disputes.  If any such dispute arises, we, and our associated Companies shall have the right to suspend, withdraw or cancel the domain name and website without prior notice.

2.4.  We are signed under the Data Protection Act, which means that we shall at all times keep your banking details as required for payment of domain names and/or web site hosting confidential.  Once your domain name/hosting package has been registered through us, all documents relating to your banking details will be destroyed using a highly secure cross-cross shredder.  We shall notify you by telephone should your details be required again for any reasonable cause, such as renewals.

2.5.  Mike Pitches Computer Services will not accept any responsibility for loss of service in the event of server downtime, be it scheduled or un-scheduled.

 

3.   Email

We make no representation and give no warranty as to the accuracy or quality of information received by any person via email from the Server and we shall have no liability for any loss or damage to any data sent via any email link.

3.1.  You represent, undertake and warrant to us that you will use the Web Site allocated to you only for lawful purposes.  In particular you shall accept that;

3.2.   You will not post, link or transmit
(a)   any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way;
(b)   any material containing a virus or other hostile computer program;
(c)   any material which constitutes, or encourages the commission of a criminal offence, or which infringes any patents, copyrights, trade marks or any other similar rights belonging to any other person which may subsist under the laws of any jurisdiction.
3.3.  We shall at all times keep your personal information required by your I.S.P. confidential.  It is your responsibility to keep your username and password safe.  We accept no responsibility for such information being accessed by any unknown party.
3.4.  You shall procure that all mail is sent in accordance with applicable legislation (including data protection legislation) and a secure manner;

3.5.  In the case of an Individual User, you must be over the age of 18 years.  If the User is to be a Company, then the Services shall not be used by anyone under the age of 18 years.

3.6.  While we, along with our associated Companies will make every effort to ensure the integrity and security of the Server and Internet, we cannot be held responsible for "hackers" and other unauthorised users, and we shall accept no liability for non-receipt and/or the misrouting of email or for any other failure of email. 


4.       Web Site Design

4.1.   We will make every effort to produce a web site solution, which accurately reflects your requirements.  However, we cannot be held responsible for any losses incurred either directly or indirectly as a result of errors occurring in the web site.

4.2.   We shall at all times ensure within our reasonable powers that your web site remains on your allocated space on the Internet.  However, we cannot be held responsible for interruptions of Service, or downtime of the Server. 

 

5.     Payment

5.1. All payments must be in pounds sterling, and can be in cash, or cheque, accompanied by the relevant and valid cheque gaurantee card.. Cheques should be crossed and made payable to “Mike Pitches”. We are considering accepting payment via credit card in the future.

5.2. A deposit amounting to 20% of the total contract value is required before commencement of work, which will be deducted from the final invoice. The invoice will be submitted to you upon completion of our work and unless otherwise agreed in writing is to be paid in full within 7 days. If payment is not made within the agreed period, we reserve the right to remove or suspend your web site from the Server.

 

6. Marketing

6.1. The Company reserves the right to use completed web sites for marketing and advertising purposes where deemed appropriate.

 

7. Renewals

7.1. Where the Client has elected to allow us to control renewals of domain registration and website hosting, we will notify the client when renewal payments are due. We give at least a week's notice, but it should be made clear that websites WILL be deleted by the hosting company if renewals are not actioned after approx. 5-10 days after the expiry date. We cannot be held responsible for lost websites and email systems if such action has been taken if the client hasn't contacted us in time.

 

8.    Termination

8.1.    If you fail to pay any sums due to us as they fall due, we may suspend the Services and / or terminate this Agreement forthwith without notice to you.

8.2.    If you break any of these terms and conditions and you fail to correct the breach within thirty days following written notice from us specifying the breach, we may terminate this Agreement forthwith upon written notice.

6.3.    If you are a Company and you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to terminate this Agreement forthwith without notice to you.

6.4.    On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your Web Site and to remove all data located on it.  We shall be entitled to delete all such data but we may, at our discretion, hold such data for such period as we may decide to allow you to collect it at your expense, subject to payment in full of any amounts withstanding and payable to us. We shall further be entitled to post such notice in respect of the non-availability of your Web Site as we think fit.

These Terms and Conditions refer only to services and contracts offered by Mike Pitches Computer Services.  Other conditions will apply to certain services.
